Hosting & Acceptable Use Policy

Effective date: 28th January 2026
This Hosting & Acceptable Use Policy (“Policy”) forms part of the Arcus AI Managed Website & eCommerce Services Agreement and is incorporated by reference. Capitalised terms have the meanings given in the Services Agreement.

1. Scope of This Policy

1.1 This Policy governs the use of hosting, server resources, email services, bandwidth, disk space, SSL certificates, and related infrastructure provided by Arcus AI as part of the Services.

1.2 By using the Services, the Client agrees to comply with this Policy at all times.

2. Hosting Services Overview

2.1 Arcus AI provides managed hosting as part of the Client’s selected Package.

2.2 Hosting services include, where applicable:

Website hostingList Item 1
SSL certificates
Server security and monitoring
Domain-based email hosting
Platform access and infrastructure management
Bandwidth and disk space allowances

2.3 Hosting services are provided on a shared or managed infrastructure basis unless otherwise agreed in writing.

3. Disk Space & Bandwidth
3.1 The Services include unlimited disk space and unlimited bandwidth, subject to fair usage and acceptable use (“Unlimited*”).
3.2 Unlimited means usage that is reasonable, lawful, and consistent with the normal operation of a business website or eCommerce store.
3.3 Usage must not:

Cause excessive server load
Adversely affect platform performance
Interfere with other clients’ services
Be used primarily for storage, file hosting, backups, or media distribution unrelated to the website

3.4 Where usage exceeds fair usage levels, Arcus AI may:

Contact the Client to discuss optimisation or reduction
Recommend an upgrade or alternative solution
Apply additional charges in accordance with the Services Agreement and Schedule 1 – Add-On Fees & Charges

4. Email Hosting

4.1 Domain-based email accounts are included as stated in the Client’s selected Package.

4.2 Each included email account provides 10GB of storage, unless otherwise stated.

4.3 Additional email accounts or increased storage may be provided as add-on services, subject to additional fees.

4.4 Email services must not be used for:

Spam, bulk unsolicited messaging, or mass marketing without consent
Distribution of malware, phishing, or harmful content
Activities that breach applicable laws or regulations

4.5 Arcus AI reserves the right to suspend or restrict email services where misuse is detected.

5. SSL Certificates & Security

5.1 SSL certificates are provided as part of the hosting Services where stated in the selected Package.

5.2 Arcus AI manages SSL provisioning and renewal during the term of the agreement.

5.3 The Client acknowledges that no online system is completely secure and that Arcus AI does not guarantee absolute security.

6. Prohibited Use

The Client must not use the Services for any purpose that is unlawful, abusive, or harmful, including but not limited to:

6.1 Hosting or distributing:

Illegal content
Copyright-infringing material
Malware, ransomware, spyware, or malicious code
Hate speech, harassment, or abusive content

6.2 Activities that:

Violate data protection or privacy laws
Infringe intellectual property rights
Facilitate fraud, scams, or deceptive practices
Interfere with network integrity or security

6.3 Use of automated scripts or processes that place unreasonable load on systems without prior written consent.

7. Third-Party Software & Integrations

7.1 The Client may request third-party integrations, subject to technical compatibility.

7.2 Arcus AI is not responsible for:

Availability, performance, or security of third-party services
Changes made by third-party providers
Failures or vulnerabilities introduced by third-party software

7.3 Any damage, instability, or performance issues arising from third-party integrations requested by the Client are the Client’s responsibility.

7.4 Remedial work required to address such issues may be chargeable in accordance with the Services Agreement and Schedule 1 – Add-On Fees & Charges.

8. Monitoring & Enforcement

8.1 Arcus AI may monitor usage to ensure compliance with this Policy.

8.2 Where a breach is identified, Arcus AI may:

Issue a warning
Require corrective action
Temporarily suspend affected services
Permanently terminate services in serious or repeated cases

8.3 Arcus AI is not liable for losses arising from enforcement actions taken in accordance with this Policy.

9. Suspension & Data Deletion

9.1 Hosting services may be suspended in accordance with the Services Agreement for non-payment, breach, or policy violations.

9.2 During suspension, websites and services may be inaccessible.

9.3 If suspension continues for thirty (30) days or more, Arcus AI may permanently delete hosted data, subject to legal obligations.

9.4 The Client is responsible for maintaining independent backups of all content and data.

10. Changes to This Policy

10.1 Arcus AI may update this Policy from time to time.

10.2 Updated versions will take effect upon publication or notification.

10.3 Continued use of the Services constitutes acceptance of the updated Policy.

11. Governing Law

This Policy is governed by the laws of England and Wales.
